Requirements for Services

Filing Trademarks

  1. Trademarks in Grenada are governed and filed in accordance with the Trademarks Act No. 1 of 2012. The Act is regulated by Statutory Rule & Order No. 18 of 2012.
  2. According to the Act, a trademark is “any sign capable of being represented graphically, which is capable of distinguishing goods or services of one undertaking from those of other undertakings” (Section 2 (1), Trademark Act No.1 of 2012).

Registration

  1. Authorization of Agent using (Form No.6) – this form must be duly completed and executed by the owner or a representative of the company by which it is owned. Where the owner of the mark is a company, the seal of the company is required to be affixed on the form.
  2. Your official instructions in writing using (Form No.1) – These instructions should contain the proprietor name and address, a replica of the trademark and the details of the respective class(es) using the WIPO Nice International Classification in which the trademark is to be registered.

Renewal

  1. Authorization of Agent using (Form No. 6)
  2. Your official instructions in writing using (Form No. 3) – These instructions should contain a replica of the trademark and the details of the prior registration in Grenada, namely the Registration Number the Registration date, filing date, the next renewal date and the proprietor name and address.

Change of Proprietor’s Name and or Address

  1. Authorization of Agent using (Form No.6)
  2. The original or a certified copy of the document evidencing the respective change. All documents are required to be replicated in English and also notarise.
  3. Your official instructions in writing using (Form No.5) These instructions should contain a replica of the trademark and the details of the prior registration in Grenada, namely Data to be changed and Data as changed.

Assignments/Change in Ownership

  1. Authorization of Agent using (Form No.6)
  2. The original or a certified copy of the document evidencing the assignment (namely a deed of assignment) or the document evidencing the change in ownership.
  3. Your official instructions in writing (using Form No.4) These instructions should contain a replica of the trademark and the details of the prior registration in Grenada, namely the old owner(s) and new owners(s).
